Terms & Conditions for FrēskāPro

These Terms & Conditions (“Terms”) govern your access to and use of FrēskāPro, including its web application, mobile applications, and related services (collectively, the “Services”), operated by FrēskāPro (“we,” “us,” or “our”).
By registering for, accessing, or using FrēskāPro, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility & Account Registration
- You must be at least 18 years old and legally capable of entering into contracts to use the Services.
- You agree to provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities conducted under your account.
2. Scope of Services
FrēskāPro provides a cloud-based software platform for managing salon and spa operations, including but not limited to:
- Appointment scheduling
- Client and staff management
- Billing and subscriptions
- Inventory management
- Business intelligence and analytics
We reserve the right to modify, update, or discontinue any feature at our discretion.
3. Subscription Plans & Payments
- FrēskāPro is offered on a subscription basis.
- Fees are billed in advance on a monthly or annual cycle.
- All fees are non-refundable, except where required by law.
- Failure to make timely payments may result in account suspension or termination.
- We reserve the right to revise pricing with prior notice.
4. Free Trials & Promotions
If a free trial or promotional period is offered:
- It is provided for evaluation purposes only.
- We may limit functionality during the trial.
- Abuse of trial offers may result in termination.
5. User Responsibilities
You agree:
- To use the Services only for lawful business purposes
- Not to misuse, resell, or sub license the Services without authorization
- Not to upload malicious code or engage in security breaches
- To obtain all required consents from your clients for data processing
- To comply with applicable laws and regulations
6. Data Ownership & Usage
- You retain ownership of all business and client data you upload.
- You grant FrēskāPro a limited license to process data solely to provide the Services.
- We do not sell your data.
- Aggregated and anonymized data may be used to improve platform performance and analytics.
7. Intellectual Property
- FrēskāPro, including software, analytics models, trademarks, and documentation, is our intellectual property.
- You may not copy, modify, reverse engineer, or distribute any part of the Services.
- No rights are granted except as expressly stated in these Terms.
8. SAAS Analytics & Reporting Disclaimer
Business insights and analytics generated by FrēskāPro are provided for informational purposes only.
We do not guarantee business outcomes, revenue growth, or performance improvements.
9. Third-Party Services
The Services may integrate with third-party tools (payment gateways, messaging services, accounting platforms).
We are not responsible for third-party services, availability, or data practices.
10. Confidentiality
Each party agrees to maintain the confidentiality of non-public business information received through the Services.
11. Service Availability & Support
- We aim to provide high availability but do not guarantee uninterrupted service.
- Maintenance or upgrades may cause temporary disruptions.
- Support is provided according to your subscription plan.
12. Termination
We may suspend or terminate your access:
- For violation of these Terms
- For non-payment
- For illegal or abusive usage
Upon termination:
- Your access will cease
- Data retention will follow our Privacy Policy
13. Limitation of Liability
To the maximum extent permitted by law:
- FrēskāPro shall not be liable for indirect, incidental, or consequential damages
- Total liability shall not exceed the fees paid by you in the preceding 12 months
14. Indemnification
You agree to indemnify and hold FrēskāPro harmless from claims arising out of:
- Your misuse of the Services
- Violation of laws or third-party rights
- Client data disputes
15. Governing Law & Jurisdiction
These Terms shall be governed by the laws of [USA/Edison], and courts located in [Edison] shall have exclusive jurisdiction.
16. Amendments
